Construction Site Requirements 


Construction on a TCEQ Level

Construction is broken down into Small and Large Construction Sites.

Small Construction sites are disturbed areas that are between 1 and 5 acres. These sites even if you are only disturbing a small area within this site, is still required to meet the same requirements. Those requirements are:

Prepare a Stormwater Pollution Prevention Plan (SWP3/SWPPP)

Post a Small Construction Site Notice (CSN/SCSN)

Implement the SWP3 prior to any earth disturbing activities

Submit a Copy of the CSN to the Municipality prior to earth disturbing activities


Large Construction sites are sites that disturb 5 acres or more. These sites even if you only disturb a small area within the site, is still required to meet the same requirements. Those requirements are:

Prepare a SWP3

Submit a Notice of Intent (NOI) to TCEQ

Post a Primary (Large CSN) Operator Construction Site Notice

Implement the SWP3 prior to any earth disturbing activities

Submit a copy of the Primary operator CSN to the Municipality prior to earth disturbing activities

Primary Operator – The entity/contractor that is in charge of the plans and specifications and/or the day to day operations of the site.

 Industrial Requirements

Based on the Industrial activity, and the Standard Industrial Code (SIC) an industry may be required to submit a Notice of Intent (NOI) to the Texas Commission on Environmental Quality (TCEQ) and have a Stormwater Pollution Prevention Plan (SWP3/SWPPP) prepared and implemented.

Dependent on the activity depends on the requirements for the facility. Facilities are required to sample stormwater during a rain event are required to sample for 12 Metals, and then there may be some additional testing requirements based on the activity, and example would be an airport. They must sample for the 12 metals and sample for ammonia – nitrogen.  Other requirements could be to store all materials inside a building or under cover.
